1. Scope of Services
Listenza agrees to provide lead generation and marketing support designed to help the Client connect with qualified, interested, and exclusive home seller leads. All leads will be targeted based on the Client’s market preferences and criteria.
The Client acknowledges that successful results depend on their own responsiveness, follow-up, and conversion efforts.
2. Payment Terms
- Sign-Up Fee: A $450 setup fee is due upon signing this Agreement.
- Reimbursement Option: The Client may deduct this $450 fee from their first successful closing generated through Listenza leads.
- Referral Fee: For any closed transaction (buying or selling) that occurs through a Listenza-provided lead, the Client agrees to pay a 20% referral fee on the Client’s net commission (after broker split).
- Payment Authorization: By submitting payment, the Client authorizes Listenza’s secure, PCI-compliant payment processor to process the agreed amount. Listenza does not store or handle card information directly.
3. Lead Delivery
- Listenza will deliver the first qualified lead within 30 days of the Agreement date.
- The Company will provide a total of 9 exclusive seller leads within 90 days.
- A lead will be considered qualified if it meets the following conditions:
- Located within the Client’s target market.
- Has expressed intent to sell within 3–6 months.
- Is the legal owner or authorized decision-maker.
- Has consented to be contacted by the Client.
- Leads that are non-homeowners, uninterested, or unreachable after three contact attempts within seven days will be reviewed. If validated as such by Listenza, one replacement lead will be provided within the contract period.
- Listenza reserves full discretion to determine final lead validity based on communication records and verification logs.
4.Client Responsibilities
- The Client agrees to promptly contact each lead provided and maintain consistent follow-up.
- The Client must provide feedback on lead quality and engagement status.
- Leads provided by Listenza are for the Client’s use only and may not be resold, shared, or reassigned.
- If no feedback is received within seven (7) days of lead delivery, the lead will be deemed valid and accepted by the Client.
5.Refunds, Disputes & Duration
- Refund Eligibility:
- Refund requests may be submitted only within 30 days of signing and only if no qualified lead has been delivered.
- Eligible refunds are limited to 50% of the setup fee and processed within 60 business days of approval.
- Refund Exclusions:
- Refunds are not applicable once at least one qualified lead has been delivered or if the Client fails to follow up in good faith.
- No disputes or refund claims will be accepted after the initial 30-day period.
- Agreement Term: This Agreement remains valid for 90 days from the signing date.
- Ongoing Obligations: The referral fee clause remains enforceable for any future transaction resulting from Listenza-provided leads, even after the 90-day period expires.
6.Support & Tools
- Standard Support: Listenza provides up to 10 hours per business day of email and chat support.
- Lead Tracking: A shared Google Spreadsheet will be provided for lead tracking and notes.
- Exclusions: This plan does not include paid advertising, social media management, appointment scheduling, WhatsApp support, live call transfers, or monthly performance reports unless specifically added as an upgrade.
7. Holiday Observance
Listenza observes all U.S. national public holidays.
Support and services may be paused during these dates, with timelines automatically adjusted.
If additional time off is required beyond national holidays, Listenza will notify Clients at least one week in advance to maintain service continuity.
8.Confidentiality
Both parties agree to keep all proprietary and client information strictly confidential.
No information may be shared, reproduced, or disclosed to any third party without prior written consent, except as required by law.
9.Limitation of Liability
Listenza shall not be liable for any indirect, incidental, or consequential damages arising from the use of provided leads or services.
Lead conversion, sales performance, or market outcomes remain the sole responsibility of the Client.
10.Entire Agreement
This Agreement represents the full and final understanding between Listenza and the Client.
No verbal promises or external statements modify these terms unless agreed in writing by both parties.
Payment Authorization:
By submitting payment for this plan, the Client authorizes Listenza to process the agreed amount through its secure, PCI-compliant payment processor for the services described in this Agreement. The Client understands that all card details are entered directly on the processor’s secure platform and are not stored or handled by Listenza. This authorization confirms the Client’s approval of the transaction and acknowledgment of the payment terms outlined herein.
